Late on the evening of Friday, April 11, the already shaky Italian constitution is painted with another fascist black page, it is the new "security" decree, the decree of April 11, 2025 n.48, which came into force on April 12 through its publication on the Official Journal website. There are still 60 days before it is definitively approved by the Chamber and Senate but the attitude of this government is clear, the Constitution must be filled with fascist laws with kicks, punches and coups. ---- This is yet another restriction of the rights that are regularly taken away from us through coups, bureaucratic fascism and political games of propaganda and ideology, aimed at penalizing always and only the same people with new restrictions, aggravating circumstances and sanctions. Since its first day, this government has inserted about 60 new crimes arriving at 500 more years of prison in the Criminal Code. This decree hits hard those who in this necro-capitalist society continue to be pushed to the margins because they do not have the same opportunities as others, or because they do not submit to the logic of death and oppression of the market that sees in people only consumers and in territories only potential goods to exploit and squeeze for the bank account of the usual 1%. With this umpteenth law the State openly shows its only interests, its own security and perpetual existence by striking in particular the people who do not fall into line, through control, punishment and propaganda creating consensus with terror.

This is an "ad personam" law but not one of those we saw in the Berlusconi years in favor of the politician of the moment or the sister or father of this or that politician, no, in this case it is a law that the neo-fascist government has designed to target certain people and categories (prisoners, detained mothers, migrants, squatters, activists, those who "beg") while at the same time the power of the armed wing of the State, the police and the secret services, increases in a disproportionate and terrorist way.

Having understood that the controversial DDL1236 (formerly 1660) would never have obtained the results and consensus hoped for in parliament, also for economic reasons, already openly contested by the OSCE (Organization for Security and Cooperation in Europe), the Council of Europe and also the UN, with a real political coup worthy of nostalgic fascists, this government, with the approval of Mattarella, passes a decree-law (emergency instrument) avoiding democratic discussion in parliament. A liberticidal decree that stinks of semi-martial law in a pre-war context that transforms protest into a crime and dissent into a crime. As soon as it came into force, the United Nations wrote again to the Italian government saying they were <<alarmed>>.

Of course, this further form of repression against those who oppose exploitation, the dissipation of fundamental values such as freedom, empathy, the right to protest, human dignity was an urgent need that could not be postponed. And the mafiosi? The corrupt? the scammers? The inhumanely overcrowded prisons and the suicides inside them? The high cost of living? Italy that has become a large, scattered hotel for tourists? The 200,000 young people who emigrate every year with a 20% increase in 2024 alone? Nothing!

The national network against the security bill, which had called for demonstrations in Rome on April 4, commented: "From now on, Italy is a less democratic country, ... where the rights of the last are a problem of judicial order and not social".

Discussing all the provisions of this decree is outside the intention of this article and we do not want to poison our readers too much, to whom we recommend a careful reading of this decree, perhaps in the company of a light joint, actually no, that is now illegal ... art. 18 of this decree. Try with malox or a herbal tea until they are allowed. Below we report just some of the absurdities:

In this decree There are about 13 articles from 19 to 31 that only talk about further protections and shields, including fiscal ones, for the police (the order of the State), including the optional use (i.e., at convenience) of the bodycam, and also the possibility for officers to carry weapons, even without a license, off duty (Art. 28), always to make the community safer... Clearly nothing about identification codes on uniforms, an important issue also for Amnesty International which in 2022 had collected 155,000 signatures to request them in line with international standards. Article 14 brings the roadblock (adding the railway) from an administrative offense to a criminal offense. Articles 26 and 27 and from 34 to 38 further exacerbate the situation in prisons and CPRs, also leading those who carry out non-violent forms of protest to risk further convictions.
But of this new weapon of the Penal Code (the Legislative Decree of 11 April 2025) two fundamental aspects are evident beyond the propagandistic ones and the "security" of the government.

The first: there is an indissoluble link between the escalation of war and the increase in repression here as elsewhere. As already highlighted in our special on prisons in the March 2025 issue, dissidents, antagonists and prisoners have always been considered as the internal enemy to be destroyed, and for the State there is no difference between the external enemy and the internal one, indeed in some ways the internal one is even more dangerous, because it moves the masses from within, solicits consciences with the same language and the same culture, criticizes its values and its false freedom from within. The threat of the "internal enemy" is not linked to an appropriation of territory and perhaps does not even constitute an economic risk, the internal enemy is first and foremost a psychological enemy, it is a traitor to the rules and internal lines, it is seen as a rival of the most holy "homeland"!!! So these must be punished, repressed and hidden and also removed outside the borders like the migrants in Albania. And let it be clear that people in the CPRs (where they also die) are there for administrative reasons because of the Turco-Napolitano law, the same law that made human empathy illegal (the rescue at sea of those in danger of life art. 12 286/1998). It is not a question of right or left, all States are the physical and psychological expression of oppression!

The second: the class struggle is also carried out through the Penal Code. What do I mean? over the last 60 years we have seen the gradual and regular increase in criminal laws that increasingly restrict people's movements and freedoms but in reality if we then look at who ends up in prison and is heavily penalized they are always the most vulnerable groups of the community while politicians and rich businessmen always get away with it in one way or another. I give some examples:

Cuffaro (convicted for external association with a mafia) just 5 years out of 7 of sentence. Berlusconi (4 years for tax fraud but converted into arrests in his 4500 square meter villa, with 126 rooms and a 120 hectare park), Dell'Utri (7 years for external complicity in mafia association but served only a part), Tremonti (several convicted, including tax evasion with 4 years in prison, he only served 2 in his "little house" in Rome in via Campo Marzio until he obtained probation) vs, for example, Stefano Cucchi who died in prison in 2009 for drug possession, Giuseppe Uva, 12 years for robbery, despite having confessed. Not to mention the continuous narrative that wants to see activists in the same light and convictions as mafiosi, or the dozens of migrants who die in CPRs under the "custody" of the State.

For us anarchists the issue of security has always been very clear; giving even more authority to a group of people, even armed, "selected" by an oppressive entity such as the state, to be able to condemn, harass and beat, even to kill or even manage terrorist groups undercover (art.31 d.l. 11 April '25) does not make communities or the world safer. Preventing systemic and structural issues that lead to violence and "criminality", focusing on social justice and available resources, instead can lead to united and safer communities.
