On Tuesday, July 7, the National Assembly, by a very large majority (313
votes for, 199 against), adopted the bill on the legitimate use of
firearms by police officers and gendarmes. This law destroys the few
remaining legal barriers to the expansion of police violence, allowing
the police to kill with impunity. Faced with this immense setback, the
Libertarian Communist Union calls for joining all initiatives capable of
building a broad front of resistance against state violence.
This bill, a key element of Jean-Marie Le Pen's platform, championed by
LR (The Republicans) deputies during their allotted parliamentary time,
has been adopted by Macron's party. If it completes its legislative
journey, it stipulates that henceforth all "law enforcement" forces will
have the right to shoot without being subject to an investigation. This
is nothing less than a license to kill granted to the police. Given the
number of deaths caused by the armed wing of the state, one might think
that the justice system has never been a true safeguard against police
brutality. But now, the burden of proof is completely reversed: it will
no longer be up to the police to demonstrate a situation of
"self-defense," but rather up to the victim to prove they did nothing
wrong-no easy task when one is blinded in a hospital bed or six feet
under with a bullet in the back. The presumption of self-defense
enshrines a situation already all too common in the courts, as well as
in political and media commentary on police crimes: it is up to the
victim to prove their innocence and that they committed no crime, and
not up to state agents to account for their own violence.
The reformist left tried to oppose this legislation with a mountain of
amendments and constant procedural objections. Nevertheless, as always,
the National Assembly does not protect us; it cannot act as a
counterweight, and the executive branch can always find a legislative
loophole to force its way through. Once again, government intervention
via Article 44.2 allowed for a veto vote, effectively eliminating the
left-wing amendments outright. Despite the outrage and protests of the
members of parliament, the government silenced the vote, and the
alliance of reactionaries from all sides (National Rally, The
Republicans, Renaissance) allowed the police to fire on our class with
impunity. All this happened in front of the families of the victims of
police gunfire, who were present in the chamber. We join our voices with
theirs: no justice, no peace.
The police kill, but not everyone. It kills people of color, residents
of working-class neighborhoods, undocumented immigrants, environmental
activists, and anti-fascists: it kills the working class because it
knows the danger they represent to the State and capital. It kills us,
but we will not stand for it. We saw it again yesterday: bourgeois
democracy can do nothing for us; only our struggles, our solidarity, and
our grassroots organization can save us.
The Libertarian Communist Union denounces the bill aimed at establishing
a presumption of self-defense for the police, as well as all the
previous racist and security laws that accompany the fascization of the
country and whose sole purpose is to keep us under threat to protect the
State and capital. We demand the disarmament and dissolution of the
police because no professional body should be armed and have the power
of life and death over others. The only solution is to overthrow this
power and collectively take control of issues of justice and security.
But until then, we remind you: national police, militia of capital! As
long as we do not have justice, you will never have peace!
