IN A TIME OF UNIVERSAL DECEIT - TELLING THE TRUTH IS A REVOLUTIONARY ACT

LEGAL TRIFECTA NOT ENOUGH!!
Interesting isn't it, although the Maritime Union of Australia has
argued and won its case before the Federal Court, the Full Bench of the
Federal Court and the High Court of Australia, there is still a great
deal of doubt about whether all the workers will be reinstated and how
many of them will retain their jobs in the near future. Irrespective of
the final outcome of this little saga, the reason M.U.A. members are
able to go back to work is due to the efforts of trade union and
community picketers, not the legal eagles.
The current victory has not been won in the courts, but has been won by
direct action. If there was no direct action and the movement of
containers in and out of Patrick's ports hadn't been stopped, whatever
court victories the M.U.A. and the ACTU may have won would not have been
enough to prevent the mass sackings of M.U.A. workers. Peter Reith and
his little buddy John Howard in particular are still trying to spoil the
MUA's victory in the High Court by refusing to release redundancy
payments to MUA members unless productivity gains are made and non union
members are employed on the waterfront.
The most interesting aspect of the High Court judgement is the
precedence six of the seven High Court judges gave to Corporation Law.
In their opinion the administrators main responsibility is to their
creditors, not the workforce. In other words, administrators are free
to make whatever commercial decisions they need to make to ensure that
the creditors receive the best return from the company. Before we
become lost in the twists and turns of corporation law, it's important
to remember that Patrick's current arrangements with their four labour
hire companies are quasi-legal ruses that were created to absolve the
company of any past or ongoing responsibility to their workforce.
Anybody who believes that legal victories are enough to win a workplace
dispute needs to look at the twists and turns of this particular
dispute. The M.U.A. has won a reprieve, not because of their legal
trifecta, but because men and women had the courage to take direct
action and call the Federal government, the state, the legal system and
the corporate sectors bluff.
PULL THE MIDDLE LEG JEFF!!
Ah! It's wonderful seeing Victoria's caring, sharing Premier giving the
people of Niddrie and Werribee his personal assurances that the toxic
dumps that have been given the State governments go ahead to be placed
in their suburbs won't be put there if they are not safe. Going by his
past record, Jeffrey Glib Kennett's assurances are not something that
people would have much faith in. The Kennett regime faces community
revolts across Melbourne and Victoria. Communities are sick and tired
of having their concerns and the decisions of their elected councils
overturned time and time again by the State.
Fifteen thousand people attended a protest meeting at Werribee on Monday
night to protest against the Kennett regime's decision to build a toxic
dump just outside their community. Yes, 15,000 people! These people
are adamant that CSR's plans to build a toxic dump at Werribee will
never see the light of day. They are sick and tired of listening to
State government politician's telling them what is good for them.
Even the normally moribund Victoria's Trade and Labour Council has taken
the bit between the teeth and has vowed to place black bans on the
proposed toxic dumps at Werribee and Niddrie. Their black bans coupled
with citizen initiated direct action will be enough to sink any
government plan to build these toxic dumps. The fight over the Werribee
toxic dump is shaping up to be Kennett's Waterloo, the sooner he tries
to build the dumps, the sooner Jeffrey can return to designing
advertising campaigns for second rate products.
THAT DREARY FELLOW'S SECRET LOVER
It's finally out in the open. John (God dammit I'm Prime Minister)
Howard has been sprung in bed with Pauline. Their love child, the
Queensland Liberal Party, has decided to allocate preferences to the One
Notion crowd before the Australian Labor Party. The Queensland
National's, Fisher's love child, will now definitely throw in their
support behind the One Notion crowd.
Listening to the intellectually challenged and morally bankrupt members
of the Queensland Liberal Party, it's almost enough to make a gun ringer
puke. The Queensland Liberal's decision to back the One Notion crowd is
an indication of how the Federal Liberal Party is thinking. If we cast
our minds back about twelve months, John Howard was one of Pauline's
secret admirers. Even then, it was obvious that the Liberal Party had
no intention of neutralising the One Notion crowd by striking a deal
with the Labor Party and putting Pauline and her band of merry mutants
last on their electoral tickets. The Liberal Party (let's forget about
the Nationals), likes to think of itself as a progressive animal. Many
members of the Liberal Party would find the Queensland Liberal's
decision not the put the One Notion crowd at the bottom of its
preference list a little hard to stomach. Before we pull the covers off
this lovely couple and expose their nakedness to the world, it's
important to remember that Pauline was the Liberal Party's endorsed
candidate for the seat of Oxley at the last Federal election.
It's interesting to see the Liberal Party throwing the One Notion crowd
a life line. For short term political gain, they're willing to seel
whatever principles they had for a few preferences. If all the major
political parties agreed to put the One Notion crowd last on their
preference list, Pauline's merry mutants would have been dealt a mortal
blow. Thinking about it I'm not surprised the Queensland Liberal Party
have put the One Notion Crowd above the ALP on their preference list.
With a little bit of luck their strategy will misfire and the Queensland
Liberal Party will be reduced to a telephone box minority party in the
next Queensland State government.
BOUGAINVILLE - PEACE AT LAST?
Although Alexander Downer, Australia's Foreign Minister, is doing all he
can to talk up the Bougainville peace agreement, it's more than obvious
that the whole process has a long, very long way to go. Although most
of the B.R.A.'s commanders, including the B.R.A.'s Chief Military
Commander Sam Kaouna and Joe Kabui, the Vice President of Bougainville
Interim Government, have signed on the dotted line, the President of the
Bougainville Revolutionary Army - Bougainville Interim Government,
Francis Ona, has boycotted the peace process and has warned the
Australian government that he has ordered his followers around the
former CRA Mine to shoot any Australian peace keeping monitors on sight.
The Bougainville conflict, a conflict that has been created and fanned
by successive Australian governments, is a direct consequence of the
colonial desire to draw straight lines on world maps, without taking
into account cultural and local differences. Bougainville islanders
have much more in common with Soloman Islanders than the rest of the
population of Papua New Guinea. To add insult to injury, the Australian
government in the 1960's foisted the CRA Mine on the locals to provide
P.N.G. with a cash cow on independence.
The current "peace deal" hinges on Skase, the P.N.G. Prime Minister,
honouring the Lincoln agreement signed in January this year. The
agreement revolves around the removal of all P.N.G. troops by June this
year and the holding of a convention and possible referendum to decide
the long term future of Bougainville. Although many people in
Bougainville are very weary of the nine year war, in which over 15,000
(approx 15%) of the population died as a consequence of the war, they
would be angry, very angry if the June conference is not preceded by the
removal of the P.N.G. military and followed by a referendum on
Bougainvilles future.
Bill Skase may have been able to drive a temporary wedge between Sam
Kaouna and Francis Ona, but if he doesn't keep his end of the Lincoln
agreement (and it looks like he has not intention of letting the people
of Bougainville decide their own future), the armed struggle for
Bougainville independence will flare up again. Ona is Kaouna's and
Kabui's final bargaining chip, if the June conference is not accompanied
by the removal of P.N.G. forces and followed by a referendum,
Bougainville will be plunged back into a nasty little conflict that is a
direct consequence of Australia's colonial heritage and current foreign
policy. If Downer wants one notch on his hat, in a very mediocre career
as Foreign Minister, he should be using his authority to force the
P.N.G. government to honour the letter and the sentiment of the Lincoln
agreement. He should be applying pressure on Skase to withdraw P.N.G.
troops and follow this withdrawal by a referendum on independence, so
the Bougainville people can finally decide their own future.
HAPPY 50TH BIRTHDAY ISRAEL?
When I was a child and first learnt about the holocaust and how the Jews
turned Palestine into Israel in 1948, I was very puzzled. I knew that
the holocaust had been caused by Germany but couldn't quite understand
why the Palestanian people were driven from their homelands to create a
homeland for the Jewish people. I'd always been taught that the guilty
should be made to pay and that innocent people should be left alone.
Fifty years after the creation of the State of Israel, I still ask
myself what did the Palestanian people do to deserve such a fate. If
the holocaust was carried out by the German State, the German State
should provide land in Germany for the creation of a Jewish State. The
State of Israel and the emerging Palestanian State need to merge into a
single entity that caters for the needs of both groups. There should be
enough people of good will in both camps to overcome the hostility of
the fundamentalists on both sides in this dispute.
The 50th anniversary of the creation of the State of Israel, is not a
time for celebration, it's a time for mourning. Any culture that builds
its dreams on the bones of another culture, can never be at peace with
itself until it compensates and more importantly reconciles those that
were driven from their homes. The people of Israel will know no peace
until they learn and implement these fundamental truths. Reviewing the
50th anniversary celebrations, it's obvious that many Israelis have
learnt little from their own history and continue to live in a world
that's based more on myths than reality.
ANARCHIST QUESTION AND ANSWER
Q. How would an anarchist society cope with shortages?
A. It's very easy to envisage an anarchist society existing and
successfully functioning in a region with abundant resources, it's much
more difficult to visualise an anarchist society in a region that is
beset with shortages, or is it? Shortages are part and parcel of human
existence, I don't believe that human beings will ever be able to live
in a society where everybody has access to whatever they need, let alone
want.
Forward thinking and planning can help a community to decide how they
will cope with a particular situation. The same principles can be
applied to deal with shortages in any particular situation. An
anarchist community needs to decide on a hierarchy of need. As an
anarchist society's economics revolve around the satisfaction of human
needs, communities facing shortages need to work out who can do without
a particular service or product and who can't. If there's not enough
even to go around, those with an acute need, everybody with such a need
will have to receive less, so that everybody has an equal chance of
survival. Obviously those whose needs are the greatest would receive the
most.
At the time a community is trying to deal with shortages, it needs to
activate the links they have with surrounding communities. This year we
have a shortage and you have a surplus, next year the situation may be
reversed. In both situations, mutual aid goes a long way to resolving
the problems shortages cause. Concurrently while dealing with the
shortages, the community that is experiencing shortages needs to focus
the community's mind on the problem, so they can devise ways to ensure
such shortages don't occur again.
Planning reciprocal mutual aid with surrounding communities and
distribution of scarce resources based on need, are a few ways an
anarchist community can cope with shortages. In such situations
collective action is always more productive than individual action.
ACTION BOX - PUBLIC SPEAKING
I never cease to be amazed by how few anarchists are willing to
articulate their ideas in a public forum. Although most anarchists are
able to hold their own in one to one conversations, when the opportunity
arises to speak publicly, most don't take up that opportunity. As
society relies more and more on the electronic media and the written
word, people seem to have lost the ability and confidence to speak
publicly.
Speaking publicly can be compared to playing soccer. If you want to
play soccer you need to learn the rules and practise. Although
everybody in a soccer team will never be a star, most players gain
enough skills to be able to participate in the game. Public speaking is
a similar proposition, although not everybody will be a star, each and
every one of us should be able to develop enough public speaking skills
to be able to get up and articulate our ideas in a public forum.
Instead of saying, it's not for me, I can't do it, think about spending
some time trying to develop your public speaking abilities. There are
many organisations in the community that help people overcome their fear
of public speaking, many don't cost a cent. If groups are not for you,
go to your local library and see if you can borrow books that teach you
how to speak in public. Although you may not turn out to be a star, at
least you'll be able to build up enough confidence to stand up and
speak, if the situation arises.
The time you spend learning to speak publicly is not wasted time. If
you're involved in political activity sooner or later you'll be called
on to articulate your ideas. What you have to say may be just the words
that are needed to turn a particular situation in a particular
direction. If you don't have enough confidence or the necessary skills
to speak your mind, you may find that you won't be able to influence the
course of events.
BOOK REVIEW - MALATESTA'S ANARCHY
First published as L'Anarchia by the Bibliotesca dell'Associazione,
London March 1891. Reset and Revised by Freedom Press 1995 ISBN 0900384

Malatesta told his friend the anarchist Fabbri in 1920 that he
considered Anarchy "the best thing I have written". Considering that
Malatesta was an activist for over sixty years, participated in many
revolutionary movements and has been described as one of Europe's
foremost anarchist propagandists, it's important that people interested
in egalitarian social change spare 30 minutes of their time to find out
what he had to say.
This edition of Malatesta's Anarchy is preceded by the 1973 introduction
written by the translator of the book, the well known anarchist
historian, Vernon Richards. In nine pages, he provides us with a brief
sketch of the man and his times. The introduction is followed by
Malatesta's thirty nine page essay Anarchy. The essay is divided into
eight distinct sections that tackle many of the most commonly asked
questions that anarchist activists are faced with. Re-reading this
pamphlet for the first time in twenty years, I'm struck by its
simplicity and depth.
Malatesta uses a question and answer style to deal with the doubts
people have about anarchism. He asks questions and answers them, trying
to logically deal with people's scepticism. Anarchy is not a call to
arms, it's not full of stereotyped hackneyed phrases, it's a short,
concise, patient explanation of a social and political philosophy that
is encapsulated in Malatesta's phrase "The freedom we want for ourselves
and for others is not an absolute metaphysical, abstract freedom which
in practice is inevitably translated into the oppression of the weak;
but it is real freedom, possible freedom, which is the conscious
community of interests, voluntary, solidarity."
I have no hesitation in recommending this pamphlet to people who are not
familiar with anarchist ideas. I also would like to suggest that people
who are familiar with anarchist ideas buy multiple copies of this well
presented, reasonably priced ($3.70) pamphlet and give them away as
presents to friends and family.

AUSTRALIAN ANARCHIST HISTORY
"IWW MEMBERS KNEW ONLY ONE FOREIGNER - THE BOSS"
The Industrial Workers of the World (IWW - Wobblies) was founded in the
United States in 1905 by the Socialist Labor Party. IWW clubs were
first formed in Australia in 1907 under the auspices of the Socialist
Labor Party. When the IWW split in the United States in 1908, into the
Detroit and the Chicago faction, the Australian "clubs" folded. The
first "local" of the IWW in Australia was formed in Adelaide in May
1911.
The direct action and anti-parliamentary ideas of the Chicago branch of
the IWW struck a chord among Australian workers. The Australian
Anarchist IWW was the only workers organisation in Australia that wasn't
racist. The Australian IWW appealed to all workers, regardless of
"race, colour or creed." IWW members knew only one foreigner - the
Boss. One IWW local in Queensland was composed entirely of Russian
immigrants. While the Australian Labour Party and the trade unions
agitated for the introduction of a White Australia Policy, IWW members
welcomed all workers. They actively campaigned amongst workers that
were shunned by the Labour Movement. the Australian Workers Union,
George Hardy, a prominent IWW organiser told all and sundry that the
A.W.U. could never be "the One Big Union" that they claimed they were
because it drew the colour bar. In an era of almost universal racial
hatred, the IWW in Australia was a shining example of racial tolerance
and solidarity.
PERSONAL OBSERVATION
A band of rubber, six centimetres wide was wrapped tightly round the
midriff of a struggling four meter gum, wire was wrapped tightly over
this rubber noose. For three years I'd watched the public
S-T-R-A-N-G-U-L-A-T-I-O-N of this tree. Three or four times a year I'd
pass the execution spot, the trunk below the noose was swollen. The
unsightly bulge reminiscent of the bulge you see in a snake that's just
swallowed a mice meal. Flaking brown bark covered the swelling trunk.
Above the noose sprouted a trunk, one third the size of the bulge. Our
strangulating friend continued to grow, despite this serious attempt to
throttle it. It's brothers and sisters grow tall on either side,
sympathetic to its plight but unable to help.
For three years I've watched this struggle, for three years I'd obeyed
the edit PRIVATE PROPERTY, DO NOT ENTER. Today, things would be
different, I'd made up my mind months ago to do something, anything
about our friend's plight. I crawled under the barbed wire and looked
closely at its swollen belly. The rubber and wire cut into the trunk,
years of pent up growth hadn't been able to break the bond. I could
hear the gum's family cheer me on as I applied the tip of the wire
cutters I had brought with me to the task at hand.
After a few toiled attempts, the wire exploded, the jagged end stopping
a few centimetres short of my face. Grabbing the rubber I pulled and
tugged until it gave way. The tree was finally free to grow. I slipped
under the fence, marvelling at my handiwork, leaving the wire and rubber
as an offering to this magnificent stand of gum trees. Somebody walking
past in twenty years time will wonder why one gum tree among this stand
is a little smaller and has an unsightly bulge on its trunk. Never in a
generation of guessing will the come close to learning the truth about
our mutual friend's life.
STOP PRESS - SHIFT AND SACK
Do you know how many companies have arranged their affairs so they can
play the shift and sack game? More than you think!! Even if the M.U.A.
wins every legal battle, their fate will be determined by the needs of
administrators, not the needs of the work force. As the law currently
stands in Australia, any employer can legally set up an insolvent labour
hire company, sack its workers when it wants to, go into liquidation and
not pay them a cent.
This is the essence of John Howard's "defining moment", a disposable
labour force that can be used, abused and discarded legally - that's
right - legally. So much for Howard's "defining moment." If you think
it can't happen to you, think again, it's happened to mine workers in
Queensland and New South Wales and it's now happening to the M.U.A.
Considering the effort it's taken for the M.U.A. to salvage something
tangible from the current situation, it's more than obvious that most
other workers in Australia have a snow flakes chance in hell of
resisting the combined pressure of the corporate world and the Federal
government.
The one to one contract system that the Federal government has done its
best to enact in law is not worth the paper it's written on. It doesn't
matter what your employer has promised you, if you're employed by a
dodgy labour hire firm they've set up, you have no guarantees, not even
legal ones. The banks are legally able to pick the financial carcass
clean before workers have any chance of winning back pay let alone any
contractual obligations the employer may have. If the Howard regime had
any vestige of decency left they would pass legislation through
parliament today to prevent the Patrick clones that are waiting in the
wings from pulling the same caper. Considering the Federal governments
past record, I wouldn't hold my breath waiting for them to stop the
corporate world from treating workers as disposable trash.
